Freelance Contract
This contract will be sent to you to agree upon and digitally sign before any work can begin.
The following shall constitute a contract of service made on [DATE] between [CLIENT'S NAME] (herein referred to as "Client") and Jeanette Ely (herein referred to as "Artist").
1. Work.
The Client retains the Artist to create [DESCRIPTION OF WORK]. The deliverables will consist of a sketch of the work-in-progress to be approved by the Client and one final drawing. This also includes up to 3 small revisions if the Client requests. An entire redrawing of the work is not acceptable.
2. Price and Delivery.
The Client agrees to pay a non-refundable amount of [PER HOUR] for the artwork. $20 (which takes place of the first hour's worth of work) must be paid upfront, and the remaining amount will be due within the timeframe agreed upon by the [CLIENT's NAME] and Jeanette Ely. A receipt of hours is totaled (subtracting the first hour's work) and sent to the client. The payment must be made through PayPal to [email protected].
3. Grant of Rights and Authorship Credit.
The Artist shall retain the copyright and ownership of the image, granting exclusive rights of usage to the Client for promotional, advertising, and reference purposes only. The Artist may use the artwork in the Artist's portfolio (including, but not limited to, any website that displays the Artist's work). The Client and Artist agree that when asked, the Client must properly identify the Artist as the creator of the artwork. The Client does not have a proactive duty to display the Artist's name together with the artwork, but the Client may not seek to mislead others that the artwork was created by anyone other than the Artist.
4. The Client accepts the Artist's Creative Vision.
The Client agrees that the Artist will complete the artwork in the Artist's creative style at the Artist's sole discretion. If the Client refuses to receive the artwork or demands the artwork be redone, it is understood and agreed that the Client is cancelling the Agreement, and no fee will be refunded.
5. Limitation of Liability.
The Client agrees that the Artist will not be liable for any damages (including, but not limited to, incidental or consequential damages), that arise from the Artist's performance of this commission (including, but not limited to, failure to perform in a timely manner, regardless of whether the failure was intentional or negligent.)
